It is easy to buy a gun in Texas, in most cases. There are many retailers and few barriers to ownership. 

If you grew up here, you probably already know this. However, you might not know some of the finer points of gun ownership. 

There is no waiting period

As explained on FindLaw, there is no waiting period in Texas after you buy a gun. Essentially, if you qualify, you could walk into a store, purchase a gun and walk out with your merchandise in hand. 

There is no background check if you sell your gun

Federal law requires background checks for licensed sellers. This includes most large gun retail companies. You would need a license if a certain percentage of your total income came from firearms sales. 

However, you do not have to perform a background check when selling a gun in Texas as an individual unlicensed seller. Currently, that includes individuals selling at shows and conventions — i.e. individuals may sell to other individuals in private sales during public events. 

Some people may not buy guns

Some people may not buy a gun here. Illegal buyers fall into these categories: 

  • People under the age of 18 (possible with consent of a legal guardian) 
  • Felons within five years of release or parole 
  • Anyone in a penal institution 

If you can buy, you can typically carry

People who may buy a gun here may also typically possess it and carry it. There are various exceptions to this, however. 

The most obvious exception is handguns, which you would need a license to carry, even openly. Concealed carry is synonymous with license to carry a handgun in Texas. 

There are many minor rules

There are various laws at the municipal, state and federal levels that govern the types of guns that are legal, how you may use your firearms and where you may carry. However, as you can see, the purchasing process is relatively simple.
