Put A Former Prosecutor On Your Side

Avoiding A Suspended License After A DWI

If you have been arrested for drunk driving, minor DUI or boating while intoxicated, the arresting officer probably took your driver’s license on the spot. If you were taken in for a blood alcohol test and the results indicated a BAC of .08 or greater, you likely received a notice of suspension. Either way, your driver’s license will automatically be suspended unless you take action right away.

Don’t Wait Until It’s Too Late To Request A License Suspension Hearing

You have 15 days from the date of your arrest to fight an automatic license suspension. If you do not make a request for an administrative hearing within 15 days, you lose your right to fight it.

The biggest mistake you can make after a DWI arrest is to wait more than 15 days to call a lawyer. If your license has been taken away because you are charged with an alcohol-related driving offense, call 972-578-7097 as soon as possible. At our Plano law office, we answer phone calls 24 hours a day.

In today’s society, a valid driver’s license is essential for most people, but the penalties for driving on a suspended or revoked license are harsh. You have nothing to lose by fighting to keep your license or trying to obtain a conditional or occupational driver’s license.

If you are arrested for DUI/DWI (or if you fail a Breathalyzer or Intoxilyzer test), you will be given a temporary permit that is only good for 40 days. If you don’t request a hearing within 15 days, your license will be suspended when that time is up.

Criminal defense attorney Stephen H. Miller has decades of criminal law experience. He will fight hard to help you avoid a suspended license after a DWI, BWI or DUI arrest.

Administrative License Review (ALR) Hearings

The ALR process is an administrative hearing that uses completely different procedures than the criminal courts. Although it is difficult, there are ways to win at an administrative license hearing and prevent license suspension. Attorney Miller has successfully represented many clients at ALR hearings.

Requesting An Occupational Driver’s License

If it is not possible to avoid a suspended license in your case, we will work hard to help you get an occupational driver’s license so you can continue to drive to and from work or school.

Whether or not the court will give you a conditional or occupational driver’s license depends on many factors, including your driving record, past DWI charges and other personal circumstances. Attorney Miller understands the complicated procedures and requirements necessary to obtain an occupational driver’s license, and he can also help you obtain reinstatement of a revoked or suspended license.

For help avoiding a suspended license after a DWI arrest or obtaining an occupational driver’s license, call or email our Plano firm to schedule a meeting with an experienced criminal defense lawyer. You can reach us 24 hours a day by phone at 972-578-7097.
